     Counterfeiting Philips’ Fluorescent Lamp Starters

Facts:

The Requestor is a worldwide famous manufacture of domestic appliance. Its trademark “PHILIPS” is a well-known trademark recognized by the world and has been registered in China.

In 1994, the Requestor found that as a State owned enterprise, XX Company of Jiaxin City organized to produce actually 450,000 pieces of counterfeiting PHILIPS’ fluorescent lamp starters. These counterfeiting goods were sold by the above-identified infringer in China and even to abroad.

The infringer’s acts were obviously a kind of deed infringing the exclusive right of the registered trademark intentionally. On the one hand, it aggrieved the Requestor’s reputation and interests; on the other hand, it also injured the Chinese consumers’ interests. In this case, the infringer’s selling counterfeiting products abroad, made more serious effects to the Requestor and China’s international reputation.

Consequently, AA Company entrusted the agent of Our Company to make complaint to the Administration for Industry and Commerce of Jiaxin City, Zhejiang Province.

Settlement:

Under the coordination of the Administration for Industry and Commerce of Jiaxin City, the infringer pledged not to produce and sell any infringing products ( see the Letter of Guarantee).The infringer has been imposed a fine and ordered to pay the compensation for the loss of the Requestor.
